Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Tend, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the app. You must be at least 13 years of age (or the minimum age required in your jurisdiction) to create an account and use Tend.

2. Description of Service

Tend is a caregiver coordination application that helps individuals and professional caregivers track and share daily care activities for care recipients. Features include care logging, medication reminders, care circle management, report generation, and data synchronization across devices and team members.

3. Not Medical Advice — Important Disclaimer

Tend is a care coordination and record-keeping tool. It is NOT a medical device, clinical system, or electronic health record (EHR). Information entered into or generated by Tend should never be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult qualified healthcare providers for medical decisions.

Inlet Studio LLC is not liable for: care decisions made based on information recorded in the app; missed, delayed, or incorrect medication reminders; inaccurate data entered by any user; or any adverse health outcomes related to reliance on app data.

4. Subscriptions & Billing

a. Plans

Tend offers multiple subscription tiers with differing limits on care recipients and circle members. Current pricing and plan details are displayed within the app and on the App Store listing.

b. Billing & Renewal

Subscriptions are billed monthly through Apple’s App Store and auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID settings.

c. Cancellation & Data Retention

Upon cancellation, your account and all associated care data are retained for 30 days. This grace period allows you to resubscribe without data loss in the event of a billing lapse. After 30 days, all care data, circle configurations, recipient profiles, and member associations owned by the subscription holder are permanently and irreversibly deleted.

5. User Accounts & Responsibilities

You are responsible for: maintaining the accuracy of all care information you enter into Tend; safeguarding access to your account and devices; managing your care circle membership and ensuring only authorized individuals have access; and promptly reporting any unauthorized access to your account.

You agree not to: enter intentionally false or misleading care records; share account credentials with unauthorized persons; use the app for any unlawful purpose; or attempt to reverse-engineer, modify, or interfere with the app’s operation.

6. Data Ownership & Care Records

a. Your Data

You retain ownership of all care data you enter into Tend. We claim no intellectual property rights over your content.

b. Circle Data Ownership

The subscription holder (the person paying for the plan) is the owner of the care circle(s) and associated data. For Professional accounts, the provider owns all circles they create.

c. Anonymization Upon Departure

When a member deletes their account or removes themselves from a circle, care entries they authored remain in the circle’s care record but are attributed to “Deleted User.” This preserves the continuity and integrity of the care recipient’s record.

d. Subscription Lapse

If a subscription holder’s subscription lapses and is not renewed within 30 days, all circle data they own is permanently deleted. Members of those circles may log in to independently delete their own accounts before this occurs.

7. Account Deletion

You may delete your account at any time from the Settings screen within the app. You may also remove yourself from individual care circles without deleting your full account. Apple’s App Store guidelines require that we provide the ability to delete your account and associated data. Full details on data deletion and retention are available in our Privacy Policy.

8. Activity Records

Tend records who created, modified, or deleted each care entry, and when. These activity records are visible to other members of the same care circle through the Activity Feed. Tend does not log IP addresses and does not maintain separate server-side audit logs. Activity records are stored with your care data and are deleted along with the care circle or account when you delete them.

9. Use of AI in Development

Inlet Studio LLC uses AI-assisted development tools in the design and coding of the Tend application. The Tend app itself does not use artificial intelligence, machine learning, or any automated decision-making system to process, analyze, or act upon user data. All care information you enter is stored and displayed as you provide it, without AI-based interpretation or modification.

10. Intellectual Property

The Tend application, including its design, code, features, branding, and documentation, is owned by Inlet Studio LLC and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the app for its intended purpose.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INLET STUDIO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM: RELIANCE ON CARE DATA ENTERED BY ANY USER; MISSED OR INCORRECT MEDICATION REMINDERS; DATA LOSS DUE TO DEVICE FAILURE, NETWORK ISSUES, OR SUBSCRIPTION LAPSE; OR DECISIONS MADE BASED ON INFORMATION DISPLAYED IN THE APP.

The app is provided “as is” and “as available” without warranties of any kind, either express or implied.

12. Indemnification

You agree to indemnify and hold harmless Inlet Studio LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the app, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to Tend at any time if we reasonably believe you have violated these Terms, used the app fraudulently, or engaged in conduct harmful to other users or the service. Upon termination by us, the data retention and deletion policies described in these Terms and our Privacy Policy will apply.

14. Dispute Resolution

Any dispute arising from these Terms or your use of Tend shall first be addressed through good-faith negotiation. If unresolved after 30 days, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through an in-app notification at least 14 days prior to taking effect. Continued use of Tend after the effective date constitutes acceptance of the revised Terms.
